TERMS AND CONDITIONS

The contract is for the automatic payment of tuition at McGill-Toolen Catholic High School. You, as the Responsible Party whose signature appears on this Agreement accept and agree to be bound by the terms and conditions until the total amount owed is paid in full. Additionally, you authorize McGill-Toolen Catholic High School to initiate debit entries to the account listed above or any subsequent account provided by you or your authorized representative. Your authorization will continue for the next school year upon reenrollment. Such reenrollment will be governed by the terms & conditions of that year's applicable McGill-Toolen Catholic High School Automatic Tuition Payment Agreement. Your authorization will terminate when the total balance due has been paid and reenrollment does not occur.

If your financial institution returns your payment, a $30 Returned Payment Fee will be automatically deducted from the account identified above within 20 days. A Returned Payment Fee will be assessed for each payment attempt that is returned. If any fees or payments are returned, they will be reattempted within the next 20 days. Fees are subject to change in future academic years.

If the Automatic Bank Payment date falls on a weekend or a banking holiday observed by the Federal Reserve, the payment will be attempted on the next business day. Although McGill-Toolen Catholic High School specifies the date each payment will occur, your financial institution determines the time of day the payment is debited to the account.

You may make changes to the information provided in this Agreement by written correspondence with the McGill-Toolen Catholic High School Finance Office. In the event you authorize additional services from McGill-Toolen Catholic High School, or in the event additional fees are assessed by McGill-Toolen Catholic High School in accordance with institution policy and as a result of changes authorized by you, you understand the total balance due and /or payment amount will change. You agree that your authorization of any such change, including reenrollment for subsequent years, shall constitute your authorization to change the payment amount and/or to continue payments until the total balance due is paid in full. You do not require McGill-Toolen Catholic High School to send advance notice of any adjustments resulting for any such changed authorization, which includes any reduction in the balance due and/or payment as the result of tuition assistance, or any other similar cause, or resulting from any reenrollment. However, a copy of such changed authorization or reenrollment is to be provided to you by McGill-Toolen Catholic High School.

If there will be any change in the preauthorization payment amount other than a changed authorization or reenrollment as described above, McGill-Toolen Catholic High School will give you notice of such changed amount at least ten (10) days in advance of the next scheduled payment.

You or your authorized representative may terminate this Agreement by written notification to the McGill-Toolen Catholic High School Finance Office, at any time more than 10 days prior to the next payment due date. Upon termination you will be obligated to pay and hereby authorize McGill-Toolen Catholic High School to debit the account above for the full amount owed at the date of cancellation, including all tuition and fees incurred by you until the date of cancellation.

McGill-Toolen Catholic High School may terminate this Agreement at any time without notice.

You acknowledge that the origination of automatic debit transaction to your account must comply with the provisions of U.S. law. This Agreement shall be governed by the laws of the State of Alabama. Venue for any disputes concerning this Agreement shall be the State Courts of Mobile County. This Agreement should in no way be construed to be a lender-borrower agreement between McGill-Toolen Catholic High School and you.

Upon demand of you or McGill-Toolen Catholic High School, any dispute concerning the parties' duties or liabilities under this Agreement shall be resolved by binding arbitration in accordance with the terms of this Agreement. Arbitration proceedings shall be administered by the American Arbitration Association ("AAA") or such other administrator as the parties shall mutually agree upon in accordance with the AAA Commercial Arbitration Rules. All disputes submitted-to arbitration shall be resolved in accordance with the Federal Arbitration Act (Title 9 of United States Code), notwithstanding any conflicting choice of law provision. The arbitration shall be conducted at a location in Mobile, Alabama, by the AAA or other administrator. All statutes of limitation applicable to any dispute shall apply to any arbitration proceeding. All discovery activities shall be expressly limited to matters directly relevant to the dispute being arbitrated. Judgment upon any award rendered in arbitration may be entered in any count having jurisdiction.

Notice of Privacy Statement: It is the policy of McGill-Toolen Catholic High School to protect all information provided to us by all participants in the automatic tuition payment plan. McGill-Toolen Catholic High School does not sell or share any nonpublic personal information or client lists to any third party, except as agreed to by you, or as may be necessary to complete a transaction in the ordinary course of business, or as required under an applicable law. To protect the information from access by unauthorized parties, McGill-Toolen Catholic High School maintains physical and procedural safeguards.
